Saudi Arabia approves new law to protect regional geographical indications

Saudi Arabia has approved a new Geographical Indications Protection Law aimed at safeguarding locally produced goods that are strongly linked to specific regions. The legislation protects products such as Taif roses, Saudi dates, and Najran honey from imitation or misuse, ensuring their authenticity and market value. Issued under a royal decree, the law will take effect 180 days after its publication in the Official Gazette.

The law prohibits any unauthorized or misleading use of geographical indications that could deceive consumers about a product’s true origin. The Saudi Authority for Intellectual Property (SAIP) will issue executive regulations within the same period. Violators may face penalties including imprisonment for one month to three years, fines ranging from SR5,000 to SR1 million, or both.

Offenses include counterfeiting geographical indications, falsely presenting products as originating from protected regions, and misleading packaging, labeling, or advertising. Courts are empowered to confiscate and destroy counterfeit goods and related tools at the offender’s expense. Final judgments may also be published in the media. Repeat offenders face doubled penalties and possible business closure for up to six months.

The law consists of 36 articles and establishes a national registry for geographical indications to be managed by SAIP, documenting all registered products and related transactions. It aims to strengthen consumer trust, protect Saudi heritage products, and prevent unfair competition locally and globally.
